Rubbish Removal Islington Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Islington provides rubbish removal, waste collection and related services to domestic and commercial customers. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Company refers to Rubbish Removal Islington, the waste collection and rubbish clearance service provider.
Customer refers to the person, business or organisation making a booking with the Company.
Services refers to rubbish removal, waste collection, waste clearance, loading, transportation, disposal and any related services provided by the Company.
Waste refers to any materials, items, rubbish, junk or refuse that the Customer requests the Company to collect, remove or dispose of.
Site refers to the property, premises or location from which the Company is requested to remove Waste.
2. Scope of Services
The Company offers waste collection and rubbish clearance services for household, garden, office and light construction waste, subject to applicable laws and waste regulations. The exact scope of each job will be agreed at the time of booking, based on the information provided by the Customer.
The Company does not handle certain hazardous or prohibited materials, including but not limited to asbestos, clinical and medical waste, chemicals, solvents, oils, gas bottles, explosives, corrosive substances and any other materials restricted by law or health and safety regulations. It is the Customer’s responsibility to inform the Company in advance of the type of Waste to be removed.
The Company reserves the right to refuse collection of any Waste that it considers unsafe, illegal, incorrectly described, excessive in volume or weight, or otherwise unsuitable for the Services.
3. Booking Process
Bookings may be made by telephone, email or other communication methods offered by the Company. When placing a booking, the Customer must provide accurate and complete information, including the location of the Site, access details, type and approximate volume of Waste, and any special requirements.
The Company may provide a quotation based on the information received. This quotation may be estimated or fixed, depending on the circumstances. Where an estimate is given, the final price may vary once the Company attends the Site and assesses the Waste.
A booking will be considered confirmed only when the Company has accepted the order and communicated confirmation to the Customer. The Company reserves the right to decline any booking at its sole discretion.
4. Access and Customer Obligations
The Customer must ensure that the Company has safe, reasonable and lawful access to the Site at the agreed date and time. This includes arranging for parking, entry codes, permission from building management or neighbours where required, and compliance with any local access restrictions.
If parking charges, congestion charges or other access-related fees apply, these may be added to the Customer’s invoice unless otherwise agreed in writing. The Customer must inform the Company of any such charges in advance where possible.
The Customer must ensure that the Waste is clearly identifiable and located in an accessible area. Where the Customer requests the Company to enter buildings or other structures, the Customer warrants that it has the authority to grant such access and that the area is safe for workers.
The Customer is responsible for securing and removing any items that are not intended to be taken away. The Company accepts no liability for removing items that were not clearly identified as excluded, where it was reasonable for the Company to assume they formed part of the Waste.
5. Pricing and Quotations
Prices for Services are typically based on the volume and type of Waste, the labour required, and any additional charges such as parking or disposal fees. The Company will normally provide a price guide or estimate before attending the Site.
On arrival, the Company’s team will confirm the final price once they have inspected the Waste. If the volume, weight or nature of the Waste differs from the information provided at the time of booking, the Company may adjust the price accordingly.
Where the Customer does not accept a revised price, the Company reserves the right to cancel the Service and charge a call-out or cancellation fee to cover time and travel costs.
6. Payments
Unless otherwise agreed, payment is due on completion of the Services on the same day. The Company accepts common forms of payment such as cash, debit or credit card, bank transfer or other methods communicated by the Company.
For business customers or larger projects, the Company may require an upfront deposit or full payment in advance. Where credit terms are agreed, invoices must be settled within the period stated on the invoice.
If payment is not made on time, the Company may charge interest on overdue amounts at the statutory rate or a reasonable commercial rate, together with any reasonable costs incurred in recovering the debt.
7. Cancellations and Amendments
The Customer may cancel or amend a booking by giving the Company reasonable notice. Where possible, at least 24 hours notice should be given for standard bookings. For larger or specialised jobs, the Company may require longer notice, which will be explained at the time of booking.
If the Customer cancels with insufficient notice, or if the Company is unable to carry out the Services due to the Customer’s failure to provide access or accurate information, the Company reserves the right to charge a cancellation or call-out fee.
The Company may cancel or reschedule the Services if it is unable to perform them due to circumstances beyond its reasonable control, including extreme weather, traffic disruptions, vehicle breakdown, staff illness, safety concerns or changes in relevant laws or regulations. In such cases, the Company will aim to notify the Customer as soon as reasonably practicable and offer an alternative time where possible.
8. Customer Conduct and Health and Safety
The Customer must cooperate with the Company’s staff and follow any reasonable instructions relating to health and safety, access and site conditions. The Company’s team may refuse to carry out work if they consider that conditions at the Site pose a risk to health, safety or property.
The Customer must not ask or encourage the Company’s staff to undertake any activity that is unsafe, contrary to the Company’s policies or in breach of waste regulations or other laws.
9. Waste Regulations and Environmental Compliance
The Company operates in accordance with applicable UK waste management and environmental regulations. All collected Waste will be transported and disposed of using licensed facilities or authorised partners wherever required.
The Customer confirms that they are the owner of the Waste or have the authority of the owner to arrange for its removal and disposal. By providing the Waste to the Company, the Customer transfers ownership of the Waste to the Company at the point of collection, subject to compliance with relevant laws.
The Customer must not include in the Waste any materials that are prohibited by law or that the Company has specified as unacceptable. If such materials are discovered, the Company may refuse to remove them, or may charge additional fees for handling, returning or arranging specialist disposal.
The Company aims to minimise the environmental impact of its activities by promoting reuse and recycling where possible. However, no guarantee is given as to the proportion of Waste that will be reused, recycled or recovered.
10. Liability and Limitations
The Company will exercise reasonable care and skill when providing the Services. However, the Company’s liability to the Customer is subject to the limitations set out in this section.
The Company will not be liable for any loss or damage arising from inaccurate information provided by the Customer, unsafe conditions at the Site, or the presence of concealed or hidden services, fixtures or items that could not reasonably be identified before work commenced.
The Customer is responsible for protecting driveways, floors, walls and pathways as appropriate. While the Company will take reasonable care, it will not be liable for cosmetic damage to surfaces or general wear and tear caused by necessary movement of Waste or equipment, provided the Company has acted with reasonable skill and care.
Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury resulting from negligence, fraud or any other liability that cannot be excluded or limited by law.
Subject to the above, the Company’s total liability in respect of any claim arising out of the Services shall not exceed the total price paid or payable by the Customer for the specific job to which the claim relates.
The Company will not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of reputation, whether arising in contract, tort or otherwise.
11. Damage and Claims
If the Customer believes that the Company has caused damage to property, the Customer must notify the Company as soon as reasonably practicable and in any event within 48 hours of completion of the Services. The Customer should provide reasonable evidence of the alleged damage, such as photographs and a description of the circumstances.
The Company reserves the right to inspect the alleged damage and, where appropriate, may arrange for repair or compensation at its discretion. Failure to provide timely notice may affect the Company’s ability to investigate and could limit any liability.
12. Insurance
The Company maintains appropriate insurance cover in respect of its activities, including public liability insurance, in accordance with industry practice. Details of cover can be provided on reasonable request.
13. Force Majeure
The Company shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include, but is not limited to, extreme weather, natural disasters, acts of government, strikes, transport disruptions or interruptions in utility services.
14. Data Protection and Privacy
The Company will collect and process personal data about Customers in order to manage bookings, provide Services, process payments and communicate about jobs. The Company will handle such data in accordance with applicable data protection laws and will take reasonable steps to safeguard personal information.
By using the Services, the Customer consents to the Company using their contact details for operational communication relating to the booking. The Customer may request access to their personal information or ask for corrections where appropriate.
15. Complaints
The Company aims to provide a professional and reliable rubbish removal service. If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible to allow issues to be investigated and resolved where appropriate.
The Company will endeavour to respond to complaints promptly and may request further information to help assess the matter. Any remedial action will be considered on a case-by-case basis, taking into account the evidence provided and the terms set out in this document.
16. Changes to These Terms
The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice or the Company’s operations. The latest version will apply to all new bookings. Where a change materially affects existing bookings, the Company will aim to notify affected Customers where reasonably practicable.
17. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
18. Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation provided by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services. They supersede any prior discussions, correspondence or representations, whether oral or written.
If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect.
By confirming a booking or allowing the Company to commence work, the Customer acknowledges that they have read, understood and agreed to these Terms and Conditions.
